By accessing or using kwayv — AfricaSoulCentral (operated by kwayv Media, "we", "us", "our"), you agree to these Terms. kwayv — AfricaSoulCentral is a pan-African user-generated content platform. If you disagree, do not use the platform.
Minimum age: You must be at least 18 years old to register or upload content.
You are responsible for your account credentials and all activity under your account. Do not share your password. We reserve the right to suspend accounts that violate these Terms without prior notice.
License you grant us: By uploading content, you grant kwayv Media a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, display, distribute and promote your content on the platform and in marketing materials for the duration of your account.
You retain full ownership of all content you upload. We make no claim of ownership over your original works.
Prohibited content:
We comply with the Nigeria Copyright Act 2022. We operate a notice-and-takedown system consistent with Section 74. We use ACRCloud audio fingerprinting at upload to proactively detect copyrighted music before content goes live.
To file a takedown notice: Email dmca@kwayvapp.com including: (a) identification of the copyrighted work; (b) URL of infringing content; (c) your contact details; (d) statement that you are the rights owner or authorised agent.
We remove infringing content within 48 hours of a valid notice. Counter-notices may be submitted within 7 days. Three-strikes policy: repeat infringers are permanently banned.
We comply with the Electronic Communications and Transactions Act (ECTA) 2002 and the Consumer Protection Act 68 of 2008. South African users have the right to cancel subscription services within a cooling-off period as prescribed by the CPA. Content moderation also observes the Films and Publications Act regarding prohibited content classifications.
We comply with Ghana's Electronic Communications Act 2008 (Act 775) and the Copyright Act 2005 (Act 690). Ghanaian users may report infringing content or rights violations through the same DMCA/takedown process above.
Reported content is reviewed within 24 hours. We reserve the right to remove any content at sole discretion without notice. CSAM and terrorism content is immediately reported to relevant law enforcement in Nigeria, South Africa and Ghana.
Premium subscriptions are processed via Paystack under their terms. Creator Fund distributions are governed by separate creator agreements. We reserve the right to modify monetisation terms with 30 days' notice.
kwayv — AfricaSoulCentral is provided "as is" without warranties. We are not liable for user-generated content. Our maximum liability is limited to the amount you paid us in the preceding 12 months or ₦5,000 (whichever is greater). Nothing in these Terms excludes liability for death, personal injury or fraud.
These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes are subject to the exclusive jurisdiction of Nigerian courts. For South African users, the South African Consumer Court has concurrent jurisdiction over consumer protection matters.
We may update these Terms at any time. Continued use constitutes acceptance. Material changes are notified via email or in-app notice with 14 days advance notice.

kwayv Media ("we", "us") operates kwayv — AfricaSoulCentral at ekasihub.kolademensah-hub.workers.dev. We are the data controller under the Nigeria Data Protection Act 2023 (NDPA), the General Application and Implementation Directive (GAID) 2025, South Africa's Protection of Personal Information Act (POPIA), and Ghana's Data Protection Act 2012 (Act 843).

We apply data minimisation — collecting only what is strictly necessary (NDPA s.24, POPIA s.10, Ghana DPA s.17).
Your data is stored on Supabase infrastructure in the EU (Ireland). This constitutes a cross-border transfer under NDPA s.43, POPIA s.72, and Ghana DPA s.33. Supabase maintains EU-level GDPR compliance, providing adequate protection. A Data Processing Agreement (DPA) is in place with Supabase.
Your video files are stored in Supabase Storage (public CDN). By uploading, you consent to this international transfer.

Strictly necessary: Supabase session cookies (authentication) — cannot be disabled without breaking the platform.
Analytics: We may add analytics in future — you will be notified and can opt out.
Advertising (Google AdSense): When activated, AdSense uses cookies to serve relevant ads. You will receive a separate consent prompt at that time. You can opt out via Google's Ad Settings.
We do not use third-party advertising cookies without your explicit consent.
In the event of a breach affecting your personal data:
kwayv — AfricaSoulCentral is strictly for users aged 18 and above. We do not knowingly collect data from minors. If a minor's account is identified, it is immediately deleted and data purged. Contact privacy@kwayvapp.com immediately if you believe a minor has registered.
Our Information Officer is responsible for compliance with POPIA. South African users may lodge complaints with the Information Regulator at inforeg.org.za if they believe we have violated POPIA. Our processing of SA users' data is consistent with the 8 POPIA processing conditions.
We are registered or intend to register with Ghana's Data Protection Commission. Ghanaian users may lodge complaints with the DPC at dataprotection.org.gh. Processing of Ghanaian users' data complies with the principles under Ghana DPA Part II.
